《准人格研究》以我国目前对于胎儿和死者人格保护中存在的问题为出发点，借鉴比较法上最新的研究成果，并进行了适当发展和扩充，构建了包括胎儿、死者、合伙、设立中法人等非典型人和组织的权利能力及其人格权保护的准人格体系。

Author Description

刘召成，中国人民大学法学博士，2009—2010年受国家留学基金委资助在德国波恩大学访学一年。首都师范大学政法学院讲师，中国人民大学民商事法律科学研究中心兼职研究人员。主要研究领域为人格权法、民法总论、消费者权益保护法，在《法学研究》、《法学家》等刊物上发表文章近20篇。本作品获得第五届“佟柔民商法优秀博士论文奖”。

Book Abstract

这种传统民法所喜好的高度抽象的理想化的模型人的立法方式，是一种形式理性与形式正义的理念的表现。这种理念在废除旧的以人的各种外在身份对人进行区分并进行歧视对待的不平等的法律体系方面具有重要的意义，只要符合建立于人的自然属性之上的模型的人都能够受到法律平等的对待。但是这种高度理想化的人的模型，造成了对那些并不符合这一模型的人的存在的忽视。他们不但不能具有权利能力，不能作为权利义务的承担者参与法律交往，而且其是否具有人格存在，并进而可以得到人格权法的保护也存在重大疑问。
民法的各项制度作为法律的外在体系以承载和实现民法的内在价值为目的，民法的内在价值与民法的外在制度体系形成了相互对应的关系。随着社会的发展，一些新的社会价值由于其突出的地位逐渐被民法的内在价值所接受，但是却缺乏作为其承载工具的民法具体制度。因而民法的外在体系成为约束和阻碍民法内在价值实现的障碍。
传统民法的权利能力和人格权制度，是与传统民法中形式人的内在价值相适应的，承载了这种内在价值，使其得以实现。在现代社会，对于各种实质人的关注与保护成为社会的重要价值之后，建立于形式人模型之上的权利能力制度和僵化的人格权客体理论反而成为阻碍这种价值实现的障碍。死者、胎儿、合伙、设立中法人并不符合形式人模型的人和组织的人格保护不能通过传统民法的既有制度予以解决，主要是其权利能力和人格权客体方面的欠缺。
