④管理公司要求业主从管理公司认可的设计师名单中选聘设计师。
对于上述不同情形，我们将在下文分情况讨论。
在上述第1种情况下，当管理公司仅仅建议业主选聘富有经验的设计师时，业主并没有强制性义务必须按照管理公司的要求选择其满意的设计师。这种情形常见于几种情况。例如，管理公司对于在国内开展酒店业务的经验和市场地位可能较为有限，因此其与业主之间的商业条件谈判天平更倾向于业主一方。管理公司为了达到其取得本酒店项目的目的，弱化了其对于设计师水平的要求。另一种可能是因为管理公司对业主比较了解，业主对于酒店开发建设拥有足够的经验，管理公司有合理的理由相信业主建设开发酒店的能力，因此作为一种商业策略，管理公司对业主选聘设计师的问题不再进行强制性要求。在此，对于业主而言，我们认为，从保障设计品质和为保障酒店物业未来的升值潜力出发，业主仍有必要选择经验丰富、有足够高档酒店设计建设经验的设计师参与本项目。业主切不可从短期节省成本考虑出发，选聘能力不足的设计师，以免影响酒店未来开发经营及物业价值，也减少就此可能与管理公司间发生争议的概率。
关于第2种情况，在管理公司同意与业主方协商选聘设计师事宜时，管理公司会要求业主聘请的设计师应征得管理公司的同意，或起码要征求管理公司的意见，即事后认可的程序。这种设计师的选聘模式在实践中十分常见，管理公司可能会就设计师选聘事宜为业主提出合理化建议。如果业主要求，管理公司还可能为业主提供一个管理公司认可的设计师建议名单，由业主自行与设计师进行接触，并最终由业主方选聘中意的设计师。业主也可能从管理公司推荐的名单之外选择设计师，但也需要与管理公司进行沟通。
在第3种情况下，在管理公司要求业主选聘富有经验的设计师时，一般管理公司会在合同中明确要求业主选聘具备某种资质或具备某种设计经验的国际设计师。此时管理公司对业主的要求是强制性的，业主必须从具有该等资质及经验的设计师中选聘其认可的设计师。第3种情况与第2种情况的不同之处在于，由于管理公司在《管理合同》中所提出的约束性条件一般会将设计师局限在很小的范围内，因此从合同约定层面上讲，业主选择设计师的空间更为有限，而第2种情况给予业主的选择空间相比更大。
至于第4种情况，管理公司要求业主从管理公司认可的设计师名单中选聘设计师时，这种情况类似于第2种情况和第3种情况的结合，即管理公司为业主方提供认可设计师名单，业主仅可在名单中进行选择，且业主无权在管理公司提供的名单外进行选择。
