换言之，从法律角度来看，这个新的专利合同将不再会自始至终地对诺威尔公司发挥作用，因此也不会与GPL发生冲突。这真是创造性的天才之举，只有在谈判的最后时刻才可能会出现。在我看来，正是这一创举，才真正使得微软与诺威尔的突破性合作成为可能。
对于客户来说，这也是最好的解决方案。他们不用担心各方是否保证有正当的专利授权，进而避免了以后产生任何的法律争议，而且承诺不起诉协议也完全排除了他们对知识产权的任何忧虑。
在10月30目星期一的晚上，安妮·凯莉带着我们设计好的新方案来到诺威尔工作组。他们倾听了安妮的陈述。并同意连夜考虑一下。第二天上午，两个小组在九点钟分别重新开会。诺威尔工作组向小组成员和外聘律师咨询，而我们在另一个房间里紧张地等待着，有点像是在等待陪审团结束审议。
